Today's SC bench on preventive detention cases made an important observation — the subjective satisfaction of the detaining authority must be based on cogent material. Any vagueness in the grounds of detention vitiates the order entirely. For young lawyers dealing with habeas corpus matters: always challenge both the sufficiency and the relevance of the material relied upon. Don't just argue procedure.

Tip for Section 11 arbitration petitions: after the BALCO judgment, seat of arbitration determines the High Court's jurisdiction — not the place of signing. Many juniors still get this wrong. Also, don't forget that even in cases with a foreign seat, Indian courts retain supervisory jurisdiction if the award is sought to be enforced in India.
