Today's SC bench on preventive detention cases made an important observation — the subjective satisfaction of the detaining authority must be based on cogent material. Any vagueness in the grounds of detention vitiates the order entirely. For young lawyers dealing with habeas corpus matters: always challenge both the sufficiency and the relevance of the material relied upon. Don't just argue procedure.

Tip for Section 11 arbitration petitions: after the BALCO judgment, seat of arbitration determines the High Court's jurisdiction — not the place of signing. Many juniors still get this wrong. Also, don't forget that even in cases with a foreign seat, Indian courts retain supervisory jurisdiction if the award is sought to be enforced in India.

The Delhi HC's recent ruling on trademark dilution of well-known marks is a game changer for brand owners. The court held that even without confusion, use of a similar mark on dissimilar goods can amount to infringement if the earlier mark has a reputation. This aligns us with the EU approach and is a significant departure from the traditional confusion-based test.

After 10 years in family law, the one thing I wish someone had told me earlier: in matrimonial disputes, the first 3 months are about trust, not tactics. Your client is in crisis. The legal strategy can wait 2 weeks — the emotional groundwork cannot. The best lawyers I've seen in this field are the ones who know when to slow down.
